The process for Amending and Restating the Governing Documents for Brandychase at Shepherd Park is complete. The owners approved the proposed changes which were previously sent to you. The Governing Documents were given signature approval by two members of the Board and the Documents were recorded with The Office of The Registrar of Titles of Ramsey County on May 4, 2022.
One of the most important changes in the Governing Documents is Section 7.19 in the Amended and Restated Declaration which reads as follows:
7.19 Smoking Prohibited. To protect the health, safety, and welfare of all Owners, Occupants, and their guests, smoking of any kind is prohibited inside of all Units, Buildings, and Limited Common Elements throughout the Property. Owners, Occupants, and their guests shall be permitted to smoke in outdoor Common Elements, although the Board of Directors may make reasonable Rules and Regulations regarding such activity. As used herein, “smoking” shall include, but is not limited to, the use of cigarettes, cigars, pipes, vaporizers, electronic cigarettes, and other such similar products, whether legal or illegal.
